Hospitals are likely to point out that entitlement to SSI under the Social Security Act is similar to entitlement to benefits under Medicare Part A, said Andrew Twinamatsiko, an associate director at the O’Neill Institute at Georgetown University Law Center. The HHS can be expected to counter that by saying the Medicare statute is different from the Social Security Act, he said.
