​​​​On February 23, 2022, Judge Jeremy D. Kernodle issued a decision and final judgment setting aside key parts of a recent rule that creates a new federal independent dispute resolution (IDR) process. This process is required under the No Surprises Act (NSA), a federal law that protects patients from the most pervasive types of surprise out-of-network bills. The lawsuit was led by the Texas Medical Association (TMA), which argued that parts of the IDR rule are inconsistent with the NSA and should be invalidated. Judge Kernodle agreed and vacated these provisions on a nationwide basis.
