“It’s not entirely clear that this legal strategy would win, but I think that it has an extraordinarily strong case behind it,” Lawrence O. Gostin, a Georgetown University law professor, told Prescription Pulse. “When FDA approves a drug as being safe, effective, with the best national scientific evidence, it sets a national uniform standard that states cannot contradict.”
