Title 42 Exclusions of Asylum Seekers—A Misuse of Public Health Powers

Like most people’s face masks, public health measures in response to COVID-19 have fallen away. The singular exception is 42 US Code §265 (Title 42), the 1944 law that grants federal authorities the power to deny people entry into the US to limit the spread of communicable diseases. In March 2020, the Trump administration invoked Title 42 to turn back and expel asylum seekers and migrants to Mexico or their country of origin.
